Road Recovery Process Begins Despite Distractions

Despite vengeful vandalism of our community center and equipment and self promotion harassment by a disgruntled ex-board member; the selfless volunteerism of so many helpful folks throughout the community has enabled
JD670B MG the road recovery processto move forward. The ACC is pleased to report that your Association Board  has successfully penned a deal for a replacement motor-grader and bulldozer. The equipment has been inspected and driven by the community’s most experienced equipment operators and the heavy equipment mechanics among them have given it their seal of approval. The purchasing financials were initiated last week and finalized on October 6th. Hopefully the equipment will be here by Saturday’s meeting for all to see.

It’s important to note that your Board of Directors managed to accomplish this without requesting a special assessment of the membership; they understand how hard the strained economy has impacted so many of our residents. Association pennies will have to be pinched and belts tightened until next year. But your membership dues are finally being applied to a process that will make life out here better for all. Above all . . . it’s essential that we keep our volunteers organized, motivated and everyone should let them know how much they are appreciated. We’re going to need every one of them to rescue our road system from too many years of neglect.

October Membership Meeting Voting Proxy Clarification
October 7, 2009   

The AAPOA Board of Directors was recently made aware of a newsletter independently published by Ashley Hotz that has been circulated to a select group of property owners. The directors feel it is not in the best interest of the community at this time to spend needless hours responding to Ashley’s articles.  Any members with questions regarding the unsubstantiated claims in the Ashville Observer are welcome to call any of the board members.


The BOD does feel it should clarify the proxy assignment process.  The official AAPOA proxy and proposed Bylaw amendments were mailed out with the October newsletter.  We feel the membership has been sufficiently informed by the website and newsletters to make knowledgeable decisions regarding the issues to be voted upon at the October meeting.  We urge all members to attend or assign a proxy designee whom they trust. The AAPOA BOD cannot solicit proxy assignments according to our Bylaws Article III Section 6 so none of the designees mentioned by Hotz – Sandy Weilbacher, Jack Shelley, Brant Brown or Ashley Hotz were asked to be proxy representatives.


The General meeting to be held on October 10th is not an election meeting.  The AAPOA BOD has never addressed a strategy for paying a third party such as Reams and Reams out of association funds. Such a decision could be proposed as an amendment to our by-laws which procedurally requires discussion by the Bylaw review committee, composed of Chairman David McCune and members Michele Staffieri, Tim Thompson and Marilyn Watson. The committee’s recommendations are vetted by the BOD for compliance with State Statutes and approved by the association attorney before presentation to the membership for acceptance by majority vote.


The AAPOA BOD has no contract for proxy certification with Reams and Reams and has not been notified regarding arrangements with them for delivery of proxies on October 10th.  If you want to be assured your proxy is counted, the BOD recommends you send one to the AAPOA address. (Call the AAPOA Secretary at 342-3422 for a blank proxy.) If there are duplicate proxies, the proxy with the latest date will be the one considered valid.  Ashley Hotz has no affiliation with the AAPOA BOD or the ACC and neither of these organizations can be held responsible for her promises in regard to the proxy process.

Phone Service Outage Misreported In Jefferson County Journal!

The September 25th page 3, article “Deputies Seek Phone Cable Thieves” by staff writer Fran Hunt needs clarification.  In fairness to Hunt, she was most likely manipulated by a disgruntled property owners’ association ex-board member whose sole purpose was to discredit our volunteer road crew for personal promotional gain. In the report Hunt states that our community was out of phone service beginning Wednesday, September 16th; and that our road maintenance crew had cut the phone line while attempting to repair the road on the following day.  Both of those statements are incorrect. 

The road maintenance crew did not cut the phone line and we didn’t lose phone service until the morning of September 18th.  The loss of service was indeed caused by a cable theft. Recent heavy rains exposed several hundred feet of phone cable, which unfortunately resides in our deflating dirt roadways all throughout the community. As they routinely do, Embarq was working on one of those main trunk line cables several days earlier and had used their own backhoe to fully expose it. For some unknown reason, Embarq did not or could not rebury the cable and left it on the ground surface exposed and easily accessible. 

At around 10 AM on the morning of the 18th eye witnesses observed several individuals struggling to jam a large utility cable into the trunk of their car. Later inspection of the remaining cable ends clearly showed that they had been neatly sheared with cable cutters.  Information describing the individuals, the car’s description, the fact that it displayed a disabled parking permit placard and it’s Leon county license tag number were all reported to the Sheriff’s department.  Essentially Hunt reported the wrong day of the utility outage and that it had been severed by our road crew.
  Unfortunately, the inaccuracy of their report caused our road crew volunteers to be subjected to undeserved harassment, physical threats and ridicule.

Fire in our Neighborhood – an issue of critical concern”

The Ashville Observer falsely reported:
the AVFD members who had radios were out of town and did not leave their radios with other volunteers who were in the area.

FACT: 

1.    All five AAVFD volunteers with the authority to respond to medical or fire emergencies had radios at the time of the Bowling fire.  (Note:  Handing off radios to a volunteer who is untrained and unqualified to respond is prohibited.)

2.    There was only one member of the AAVFD with a radio who was out of town during the Bowling fire.

3.    Interestingly, The Ashville Observer admits in its own “article” that no radios were necessary as the volunteers were readily accessible by land line according to their source, Bill Hermann.

4.    AAVFD volunteers, as well as the Jefferson County Fire Rescue Department, were notified months in advance that volunteer AAVFD Chief would be on vacation and they had prepared accordingly. 

The Ashville Observer falsely reported:
…nobody with a Commercial Driver’s License was available to drive the AVFD fire truck to the fire.  A CDL is required… 

FACT:

5.    No CDL is required to operate the AAVFD fire truck.  However, it is mandated that drivers of AAVFD vehicles must complete an EVOC class.  At the time of the Bowling fire there were five AAVFD volunteers who were EVOC qualified; four of whom were on duty.

The Ashville Observer falsely reported:
… the law was ignored and that somebody drove the truck….

FACT:

6.    No laws were broken.

Editor’s Note:
This is another prime example of the willful use of deceitful tactics by Mrs. Hotz to self promote her own political ambitions. She has become the underlying malignancy preventing neighbor-to-neighbor healing and her antics continue to disrupt community progress.

ACC Mission Statement
The Community Coalition is a collaborative community based initiative located within the Aucilla Shores subdivision. We are dedicated to establishing effective and efficient procedures for improving our property owners' association, the road system; and protecting our property values. The ACC supports and defends the rights of every property owner to have a voice in the affairs of their association. We will also act as a public force to insure that our association governing documents and the state statutes are adhered to by the AAPOA leadership.
